ESTIMATES
Because Designer charges for design work based on time, Designer will give the client an estimated price, which is subject to a range or maximum figure. The client understands that this is an estimate, not a fixed quote or a guaranteed price.
Project may be re-estimated if, upon receipt of all project elements, if Designer determines the scope of the project has been altered dramatically from the originally agreed upon concept.
NEW WEBSITE TERMS
$50% Deposit due upon commencement of the project with the balance due and payable immediately upon the site going "live".
REVISION TERMS
All REVISIONS will be billed via email on or about the 1st of each month. Client, at no additional charge, will send postal billings upon request. Payment terms are Net 30. Check, money orders, and wire transfer are accepted. MasterCard, Visa, AMEX and Paypal payments are also accepted with an additional surcharge for applicable bank processing fees.
Client will be billed at an hourly rate, in 15 minute increments, with a 30 minute minimum charge for requested website updates and revisions. There shall be no charges to the Client for revisions or corrections or additions made necessary by errors on Designer’s part. The Client shall be responsible for making additional payments at the rate noted herein for any Client's Alterations and any other changes in original assignment requested by the Client. However, no additional payment shall be made for changes required to conform to the original assignment description.
Future website updates, revisions or additions will be completed on a first come first serve basis. Every effort will be made to complete your revisions as soon as possible, but actual time frame is dependant upon complexity of the job and designers workload at the time requested. If your revisions cannot be completed in 10 business days you will be informed.
BILLABLE EXPENSES
The Client shall reimburse, at cost plus 10%, for all direct and indirect Billable Expenses arising from this assignment, regardless of whether the assignment is Canceled or Terminated. Billable Expenses include but are not limited to costs of commissioning images, custom programming, software or run-time license costs, the payment of any sales tax due on this assignment, any travel, research, postage and delivery, photocopying, special licensing or royalty fees resulting from the use of programs that require such payments, and storage media expenses.
COMPATIBILITY
Designer will endeavor to ensure that any developed/designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the current version web browsing software Microsoft Internet Explorer and Mozilla Firefox browsers. Designer offers no guarantees of correct function with all browser software nor with future browser updates of Microsoft Internet Explorer and Mozilla Firefox browsers.
COPYRIGHTS & TRADEMARKS
The client unconditionally guarantees that any and all content including text, clip-art, graphics, photos, designs, trademarks, or other artwork furnished for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements will not infringe upon any statutory copyright and that no content provided shall contain any matter contrary to the law. Client has the right to use the likeness of all the persons depicted in the artwork where Client has supplied the likeness. Client will hold harmless, protect and defend designer and its subcontractors from any claim or suit arising from the use of any elements used for their website. LIMITATIONS
Designer’s responsibility for typographical, pricing, or other errors shall be strictly limited to correcting such errors if they are pointed out to us during timely proofreading, site testing and warranty period. It is the client's responsibility to proofread all work and to ensure that it is (a) satisfactory, (b) correct as to size, content, etc., (c) suitable for intended use, on new sites BEFORE the website is opened to the public and on “live” revisions WITHIN 24hrs of posted update.
LEGAL NOTICE
Designer does not warrant that the functions contained in the web design project will be uninterrupted or error-free. The entire risk as to the quality and performance of the web design project is with the client. In no event will Designer be liable to the client or any third party for any damages, including, but not limited to service interruptions caused by Acts of God or any other circumstances beyond our control, any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web design project, failure of any service provider, of any telecommunications carrier, of the Internet backbone, of any Internet servers, your or site visitor's computer or Internet software, even if Designer has been advised of the possibility of such damages.
DESIGNER'S LINK
Any site I design will contain a hyperlink saying "Site design by www.TrishasDesignStudio.com." This link will be placed on the footer of every page. However, it's possible to purchase the link removal.
